The Gift Card may be redeemed only for eligible services provided or expressly authorized by Aja Spa, subject to service availability, professional evaluation, scheduling requirements, and these Terms.

2. Nature of the Gift Card

An Aja Spa Gift Card represents prepaid value that may be applied toward eligible Aja Spa services.

It is not a credit card, debit card, bank account, deposit account, or investment. It does not earn interest and may not be exchanged for cash except where required by applicable law.

Unless expressly stated at the time of purchase, purchasing a Gift Card does not reserve a specific service, treatment, provider, appointment date, or service price.

3. Expiration and Balance Fees

Gift Cards purchased for monetary consideration do not expire, to the extent required by applicable Florida law.

Aja Spa does not charge inactivity, dormancy, maintenance, or periodic fees against the unused balance of a paid Gift Card.

This section does not apply to actual, non-refundable third-party transaction costs associated with an exceptionally approved cancellation and refund, as described in Section 11. Those costs are not deducted from an active Gift Card balance.

4. Purchase and Delivery

Gift Cards may be purchased through the Aja Spa website, authorized sales channels, or directly from Aja Spa when available.

The purchaser is responsible for providing complete and accurate information, including:

• The purchaser’s name and contact information;

• The recipient’s name and email address;

• The selected Gift Card value;

• The selected delivery preference;

• Any personal message included with the Gift Card.

Aja Spa is not responsible for delays or failed delivery caused by an incorrect email address, a full inbox, spam filtering, email-provider restrictions, inaccurate information supplied by the purchaser, or a temporary interruption involving a third-party delivery or payment service.

The purchaser should carefully review all information before completing the transaction.

5. Location and Eligibility

Aja Spa Gift Cards may only be redeemed for eligible services provided or expressly authorized by Aja Spa at its location in Pompano Beach, Florida.

Before purchasing, the purchaser is responsible for confirming that the recipient can reasonably visit and use the Gift Card at:

Aja Spa is not required to issue a refund because the purchaser or recipient failed to verify the Spa’s location before completing the purchase.

6. Redemption and Scheduling

The recipient must contact Aja Spa directly to:

• Verify the available Gift Card balance;

• Select an eligible service;

• Confirm service eligibility;

• Confirm availability;

• Schedule an appointment.

Aja Spa may require the Gift Card code, purchase email, digital Gift Card, purchaser information, or another reasonable form of verification before redemption.

A Gift Card may be redeemed only after the original payment has been successfully authorized, processed, and settled.

Purchasing or receiving a Gift Card does not automatically reserve an appointment or guarantee availability on a particular date or time.

7. Eligible Services and Professional Requirements

The Gift Card may be applied toward eligible services offered directly by Aja Spa at the time of scheduling.

Depending on availability and professional eligibility, eligible services may include:

• Post-operative care services;

• Lymphatic drainage;

• Therapeutic massage;

• Facial treatments;

• Waxing services;

• Foot care services;

• Other services expressly approved by Aja Spa.

Certain services may require an intake form, consultation, health history, professional evaluation, informed consent, physician authorization, or confirmation that the service is appropriate for the recipient.

The purchase of a Gift Card does not guarantee that any specific service or treatment is medically or professionally appropriate for the recipient.

Medical services, prescriptions, medications, laboratory testing, partner-provided treatments, and services requiring clinical eligibility may be subject to separate terms and may not accept an Aja Spa Gift Card unless expressly confirmed in writing.

8. Service Price, Additional Payment, and Remaining Balance

If the selected service costs more than the available Gift Card balance, the recipient must pay the difference using an accepted payment method.

If the selected service costs less than the available Gift Card balance, the unused value will remain available for future eligible services, subject to these Terms.

No cash change will be provided except where required by applicable law.

Service prices may change over time. A Gift Card preserves its monetary value but does not guarantee the price of a particular service unless expressly stated at the time of purchase.

9. Appointment Changes, Cancellations, and No-Shows

Gift Card use is subject to Aja Spa’s appointment, cancellation, rescheduling, late-arrival, deposit, and no-show policies in effect at the time the appointment is scheduled.

If an appointment is not canceled or rescheduled within the required notice period, Aja Spa may apply its standard cancellation or no-show charge to the Gift Card balance, provided that the applicable policy was disclosed when the appointment was scheduled.

A charge connected to a reserved appointment is not an inactivity or maintenance fee.

10. Final Sale Policy

Except where required by applicable law, Gift Card sales are final.

Aja Spa is not required to cancel or refund a Gift Card because of:

• A change of mind;

• Purchaser or recipient preference;

• Selection of an unsuitable Gift Card value;

• An unavailable preferred date or time;

• Relocation of the purchaser or recipient;

• Inability to schedule or attend a service;

• Failure to verify the Aja Spa location before purchase;

• The recipient’s inability to travel to Pompano Beach, Florida.

Before purchasing, the purchaser should confirm that the recipient can use the Gift Card at Aja Spa’s Pompano Beach location.

11. Exceptional Refund Requests and Payment-Platform Costs

Although Gift Card sales are generally final, Aja Spa may, at its discretion and when permitted by applicable law, review a request for an exceptional refund based on credible and documented circumstances.

Examples may include:

• An accidental duplicate payment;

• A verified technical purchase error;

• An incorrect Gift Card amount caused by a payment-page error;

• A purchaser who reasonably failed to realize that Aja Spa is located in Florida and purchased the Gift Card for someone who cannot reasonably use it.

Approval of one exceptional refund does not require Aja Spa to approve any similar refund request in the future.

Online Gift Card purchases may be processed through Stripe, card networks, banks, and other independent payment providers. These third parties may retain processing charges when the original transaction is completed, and those charges may not be returned to Aja Spa when a refund is issued.

When Aja Spa voluntarily approves a refund that is not otherwise required by law, the refund may equal the amount paid minus the actual, documented, and non-refundable third-party processing costs charged in connection with the original transaction and, where applicable, the refund itself.

Aja Spa is not required to absorb, from its own funds, a processing fee retained by Stripe, a bank, a card network, or another payment provider and not returned to Aja Spa.

Before processing an exceptional refund, Aja Spa will disclose, when reasonably available:

• The original purchase amount;

• The third-party amount proposed to be withheld;

• The estimated net refund.

This deduction applies only to a voluntarily approved cancellation and refund. It is not an inactivity fee, maintenance fee, or deduction from an active Gift Card balance.

If applicable law requires a full refund, Aja Spa will comply with that law.

12. Time and Documentation for Exceptional Refund Review

A request for exceptional refund review should be submitted within fourteen (14) calendar days after purchase and before any part of the Gift Card has been used.

The request should include:

• The purchaser’s full name;

• The email address used during purchase;

• The Gift Card number or code;

• The purchase date;

• Proof of payment;

• A detailed explanation of the reason for the request.

Submitting a request does not guarantee approval.

A Gift Card that has been used in whole or in part is not eligible for a voluntary refund unless required by applicable law.

13. Refund Method and Processing Time

If approved, a refund will be returned, whenever reasonably possible, to the original payment method.

The time required for a refund to appear depends on Stripe, the customer’s bank, card issuer, card network, and other third parties.

Aja Spa does not control bank or card-processing time after the refund has been submitted.

14. Promotional, Complimentary, and Donated Gift Cards

A promotional Gift Card, voucher, bonus, donated certificate, contest prize, referral credit, courtesy credit, or other item issued without payment of equivalent monetary consideration may be subject to separate limitations, eligibility requirements, service restrictions, and expiration terms to the extent permitted by law.

Such items may be treated differently from a Gift Card purchased at full monetary value.

15. Lost, Stolen, Shared, or Misused Gift Cards

The Gift Card and its code should be treated like cash.

The purchaser and recipient are responsible for protecting the Gift Card, code, email, link, and redemption information.

Aja Spa is not responsible for unauthorized use resulting from loss, copying, forwarding, public posting, voluntary sharing, or failure to safeguard the Gift Card information.

If the purchaser provides satisfactory proof of purchase and the balance has not been used, Aja Spa may, at its discretion, cancel and replace a compromised Gift Card code.

16. Transferability and Resale

A Gift Card may generally be transferred to another person before redemption, provided that the new recipient can use it at Aja Spa’s Pompano Beach location.

A Gift Card may not be transferred when it was expressly issued as non-transferable, is connected to a specific promotion, is suspected of fraud, or when transfer is prohibited by applicable law.

Unauthorized resale, alteration, counterfeiting, or fraudulent transfer may result in suspension or cancellation of the Gift Card.

17. Fraud, Chargebacks, and Payment Disputes

Aja Spa may suspend or cancel a Gift Card associated with suspected fraud, unauthorized payment, counterfeit activity, processing error, chargeback, bank dispute, or violation of these Terms.

If a purchaser disputes a charge after the Gift Card has been delivered or used, Aja Spa may provide the payment processor or financial institution with records relating to the purchase, delivery, communications, appointment, and redemption.

Nothing in this section limits a consumer’s lawful rights regarding actual fraud, unauthorized charges, or billing errors.

18. Cancellation by Aja Spa

If Aja Spa cancels a scheduled service, the applicable Gift Card value will remain available for rescheduling.

If Aja Spa permanently discontinues all eligible services or ceases operations, the holder’s rights will be handled according to applicable law and the circumstances existing at that time.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Aja Spa is not liable for indirect, incidental, special, or consequential damages arising from:

• Lost, stolen, or misused Gift Cards;

• Incorrect purchaser or recipient information;

• Email delivery failures;

• Temporary website interruption;

• Unavailable appointment dates or times;

• Third-party payment-platform problems;

• External banking or card-processing delays;

• The recipient’s inability to visit Aja Spa;

• A service being determined professionally inappropriate for the recipient.

Nothing in these Terms excludes liability that cannot legally be excluded.

20. Privacy and Payment Processing

Personal information collected during the Gift Card purchase may be used to process payment, issue and deliver the Gift Card, provide customer support, schedule services, prevent fraud, maintain transaction records, and comply with legal obligations.

Payment-card and financial information may be processed by Stripe or other independent payment providers under their own privacy, security, and data-processing practices.

21. Changes to These Terms

Aja Spa may update these Terms to reflect changes in applicable law, services, technology, payment processing, fraud prevention, or business operations.

The version generally applicable to a purchase is the version in effect on the transaction date, unless a later change is required by applicable law.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Florida and applicable federal law.

Any dispute will be brought in a court of competent jurisdiction serving the county in which Aja Spa is located, unless applicable consumer-protection law requires otherwise.

Nothing in these Terms limits any non-waivable consumer-protection rights available under applicable law.

23. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
